(a)
- (1) The Division of Developmental Disabilities Services shall monitor a provider to ensure compliance with this part.
(2)
- (A) A provider must cooperate and comply with all monitoring, enforcement, and any other regulatory or law enforcement activities performed or requested by the division or law enforcement.
- (B) Cooperation required under this part includes without limitation cooperation and compliance with respect to investigations, surveys, site visits, reviews, and other regulatory actions taken by the division or any third-party contracted by the Department of Human Services to monitor, enforce, or take other regulatory action on behalf of the department, the division, or its delegate.
(b) Monitoring includes without limitation:
- (1) On-site surveys and other visits including without limitation complaint surveys and initial site visits;
- (2) On-site or remote file reviews;
- (3) Written requests for documentation and records required under this part;
- (4) Written requests for information; and
- (5) Investigations related to complaints received.
- (c) The department may contract with a third party to monitor, enforce, or take other regulatory action on behalf of the department or the division.
