(a) The Division of Developmental Disabilities Services may issue CES Waiver service or complex care home certification to an applicant if:

1. (1) The applicant submits a complete application under 20 CAR § 535-202;
2. (2) The division determines that all employees have successfully passed all checks, screens, and searches required pursuant to 20 CAR § 535-302(b); and
3. (3) The division determines that the applicant satisfies this part.

(b) The division may approve an application involving a change of ownership for an existing provider if:

1. (1) The applicant submits a complete application under 20 CAR § 535-202;
2. (2) The division determines that all employees and owners have successfully passed all checks, screens, and searches required pursuant to 20 CAR § 535-302(b); and
3. (3) The division determines that the applicant satisfies this part.
