(a) The Overpayment Processing Unit of the Secretary’s Office of the Department of Human Services will make the decision concerning the feasibility of repayment for all overpayments, taking into consideration whether they resulted from:

1. (1) Administrative error;
2. (2) Misunderstanding of state policies or laws by the participant; or
3. (3) Willful withholding or incorrect statement of factual information by the participant.

(b) A review official in the Overpayment Unit will:

1. (1)

   1. (A) Review information submitted by the local offices via DHS-199 and DHS-1700.
   2. (B) Additional information from the local office may be requested when needed for a decision or further action; and
2. (2) Make a decision on the feasibility of seeking repayment relative to the disposition of the claim when collection and/or fraud referrals are indicated.
