(a) Ownership may be verified by any of the following:
- (1) Deeds;
- (2) Wills;
- (3) Contract of purchase; or
- (4) Other documentary evidence.
(b)
- (1) When two (2) or more persons own an interest in the property, the client’s ownership interest and the availability of the property as a resource to the family must be determined.
- (2) Refer to 20 CAR § 502-428.
(c)
- (1) Questions of title, ownership, and property interest that cannot be resolved by the county office may be submitted to the Office of Program Planning and Development, Slot S333, which will request a legal opinion from the Office of Chief Counsel of the Department of Human Services.
- (2) The memorandum should present the question involved, any relevant facts, with relevant documents (deeds, contracts, etc.) attached.
