(a) The Overpayment Unit of the Department of Human Services will make the decision concerning the feasibility of repayment for all overpayments, taking into consideration whether they resulted from:

1. (1) Administrative error;
2. (2) Misunderstanding of state policies or laws by the participant; or
3. (3) Willful withholding or incorrect statement of factual information by the participant.

(b) A review official in the Overpayment Unit will:

1. (1)

   1. (A) Review information submitted by the local offices via DHS-199 and DHS-1700.
   2. (B) Additional information from the local office may be requested when needed for a decision or further action; and
2. (2) Make a decision on the feasibility of seeking repayment relative to the disposition of the claim when collection and/or fraud referrals are indicated.
