1. (a)

   1. (1) The individual accused of the intentional program violation (IPV), the county office, or the Fraud Investigation Unit of the Department of Human Services may request that witnesses be subpoenaed to appear at an administrative disqualification hearing.
   2. (2) The accused individual uses the attachment to the Advance Notice of Hearing to request that subpoenas be issued.

   3. (3) The county office will:

      1. (A) Be advised by the Office of Appeals and Hearings of the Department of Human Services of any witnesses the accused individual has requested; and
      2. (B) Have five (5) days from receipt of this notice to request rebuttal witnesses.

2. (b)

   1. (1) The county office and/or Fraud Investigation Unit may use the reverse side of the County Statement (Form DHS-1208) to request subpoenas.
   2. (2) If additional subpoenas are needed by the county office on cases prepared by the Fraud Investigation Unit, these may be requested by contacting the Office of Appeals and Hearings.
3. (c) The Office of Chief Counsel of the Department of Human Services will issue the subpoenas pursuant to the terms of agreement and authority of Arkansas Code § 20-76-408.
