1. (a) A request for an administrative disqualification hearing is initiated by the Overpayment Unit of the Department of Human Services:

   1. (1) Of its own volition;
   2. (2) At the request of the county office; or
   3. (3) At the request of the Fraud Investigation Unit of the Department of Human Services.
2. (b) The county office refers cases of suspected intentional program violations to the Overpayment Unit via an overpayment report form.

3. (c) The Overpayment Unit and Fraud Investigation Unit will review the form and determine if the case is to be referred for:

   1. (1) Possible prosecution;
   2. (2) An administrative disqualification hearing; or
   3. (3) Nonfraud collection.
4. (d) If the Overpayment Unit refers the case for an administrative disqualification hearing, a copy of the referral will be sent to the county office by the Overpayment Unit.
