(a)

1. (1) The governing body shall oversee the management of a program which:

   1. (A) Maintains a comprehensive written schedule of service fees and charges; and
   2. (B) Offers a reasonable payment plan that takes into account the clients’:

(i) Income;

1. (ii) Resources; and

   1. (iii) Dependents.
2. (2) This will be reviewed and approved annually by the governing body and shall be accessible to the public, applicable to nonprofit organizations only.

(b)

1. (1) The governing body shall ensure that the program has liability insurance that provides for the protection of the physical and financial resources of the program:

   1. (A) To cover its clients, staff, and general public;

   2. (B) To include coverage of the:

      1. (i) Building;
      2. (ii) Equipment; and
      3. (iii) Vehicles.
2. (2) If part of a governmental agency, in lieu of liability insurance, the program has other proper means of protection for the items specified.
