Access to facility records and state regulatory agency records and officials
Arkansas Code § 20-10-602
- (a) The Arkansas Long-Term Care Ombudsman Program shall have access to all administrative records, policies, and documents, to which the residents have, or the general public has access, of long-term care facilities.
(b)
(1) The program is entitled to copies of all licensing and certification records maintained by state regulatory agencies with respect to all Arkansas:
- (A) Long-term care facilities;
- (B) Medicaid waiver providers;
- (C) Long-term care service providers; and
- (D) Managed care organizations.
- (2) To obtain a specific record at no cost, the ombudsman shall forward a specific request to the office, which will make the request to the Office of Long-Term Care in the Department of Human Services, as applicable.
- (c) The State Long-Term Care Ombudsman or designee has direct access to directors of governmental entities with responsibilities which impact residents.
