(a)
- (1) The Regional Ombudsman shall complete and submit a mid-year annual services plan progress report to the Office of the State Long-Term Care Ombudsman no later than April 15.
- (2) The report shall be in a format, or on a form, approved by the office.
(b) The office shall:
- (1) Review, at least quarterly, the activities and complaint data of the statewide program and each regional program, together with the regional program annual services plan and program benchmarks to evaluate program performance;
- (2) Make site visits every two (2) years to evaluate the performance of the regional ombudsman program and provide technical assistance and support as deemed necessary;
(3)
- (A)
- (i) Submit an annual report on March 1 of each year or as soon thereafter as is practicable to:
- (a) (a) The Governor;
- (b) (b) The General Assembly;
- (c) (c) The Secretary of the Department of Human Services;
- (d) (d) The Director of the Division of Aging, Adult, and Behavioral Health Services of the Department of Human Services;
- (e) (e) The Director of the Division of Provider Services and Quality Assurance;
- (f) (f) Other appropriate governmental entities; and
(g) (g) The general public.
(ii) The annual report to the Assistant Secretary of the United States Department of Health and Human Services is due January 31.
(B) The annual report shall include the following:
- (i) A description of activities carried out by the office in the year for which the report is prepared;
- (ii) An analysis of the data collected;
- (iii) An evaluation of the problems experienced by, and the complaints made by or on behalf of, residents;
- (iv) Recommendations for policy, regulatory, or legislative changes to improve quality of care and quality of life of residents;
- (v) An analysis of the success of the program; and
- (vi) A summary of identified barriers that prevent the optimal operation of the program; and
- (4) Analyze activity and complaint data to determine program trends and performance for planning purposes.
