- (a) The Division of Aging, Adult, and Behavioral Health Services of the Department of Human Services shall establish and administer the Office of the State Long-Term Care Ombudsman in accordance with the Older Americans Act, 42 U.S.C. § 3001 et seq., the Arkansas Long-Term Care Ombudsman Act, § 20-10-601 et seq., and applicable federal regulations and state rules.
(b)
(1)
- (A) The office shall ensure that:
(i) All residents of Arkansas long-term care facilities have access to the services of the Arkansas Long-Term Care Ombudsman Program; and
(ii) Each service area of the state has a designated regional program.
(B) Regional program services shall be:
- (i) Delivered through provider agencies and individuals designated by the office; and
- (ii) Operated through a grant or contract with the division or an area agency on aging.
