(a)
- (1) The State Long-Term Care Ombudsman or designee provides the trainee a written examination.
(2) The examination is designed to assess the ability to apply the complaint investigation process to sample cases by:
- (A) Identifying issues involved;
- (B) Applying relevant statutes and regulations;
- (C) Developing a plan of action that demonstrates:
(i) An awareness of the appropriate ombudsman representative’s role; and
(ii) Appropriate resolution strategies and rationales;
- (D) History of the ombudsman program; and
- (E) Residents’ rights.
(b)
- (1) The written examination will be evaluated by the State Long-Term Care Ombudsman or designee with an eighty percent (80%) score required for passing.
- (2) If the trainee does not pass the first or second time taking the exam, the State Long-Term Care Ombudsman may identify additional work to be done on the examination needed to pass.
(3)
- (A) The trainee must complete a passing examination within two (2) months in order to become certified.
- (B) Trainees may submit the written examination no more than three (3) times during the two-month period.
- (C) If the trainee does not pass by the third attempt, the trainee will not be certified.
