1. (a)

   1. (1) For initial enrollment, unemployed individuals must meet eligibility criteria for:

      1. (A) Age;
      2. (B) Income;
      3. (C) Place of residence; and
      4. (D) No additional employment.
   2. (2) Continued enrollment in the program shall require the individual to meet the age, income, residency, and no additional employment criteria.
   3. (3) Eligibility is determined at the time the individual applies to participate in SCSEP and at least once every twelve (12) months thereafter.
   4. (4) Eligibility can also be verified as circumstances require it.

2. (b) Eligibility criteria:

   1. (1)

      1. (A) Age.
      2. (B) Individuals must be at least age fifty-five (55).
      3. (C) No upper age limit restriction shall be imposed;

   2. (2)

      1. (A) Income.
      2. (B)

3. (i) The income of an individual or the family of which the individual is a member shall not exceed one hundred twenty-five percent (125%) of the family income levels established by the United States Department of Health and Human Services and approved by the Office of Management and Budget.

   1. (ii) In addition, a person with disabilities may be treated as a “family of one” for eligibility purposes.

      1. (C) The grantee/subgrantee will go by the United States Department of Labor Employment and Training Administration’s Training and Employment Guidance Letters regarding income definitions and income inclusions and exclusions when determining SCSEP eligibility.

      2. (D) Computation of income:

         1. (i) Income received during the prior twelve-month period or, if more favorable to the applicant, the six-month period annualized; and
         2. (ii) Ending on the date an eligible individual submits an application to participate in the program;

   2. (3)

      1. (A) Place of residence.
      2. (B) Individuals shall have a place of residence in the State of Arkansas and no length of residency may be imposed; and

   3. (4)

      1. (A) Unemployment.
      2. (B) A participant must be unemployed at the time of enrollment.

      3. (C)

         1. (i) If they become employed either full-time or part-time while enrolled in the program, they must exit the program.
         2. (ii) This does not include casual, nonrecurring labor such as occasional babysitting or shoveling a neighbor’s sidewalk.
         3. (c) No additional eligibility requirements shall be imposed by the project or subgrantee.
