(a)
- (1) Every psychiatric residential treatment facility shall have policies that are clearly written and current.
- (2) All policies shall be available for review by all facility staff and Department of Human Services personnel.
(3)
- (A) All policies shall be available for review upon request by a resident or a resident’s parent or legal guardian.
- (B) Policies regarding physical and chemical restraints must be provided to the resident’s parent or legal guardian.
- (b) All policies shall be reviewed annually by the governing body or management team.
(c) The psychiatric residential treatment facility shall have policies governing:
- (1) Admission and discharge;
- (2) Personnel;
- (3) Grievance procedures;
- (4) Behavior management;
- (5) Use of restraint;
- (6) Mandatory reporting of abuse or neglect;
- (7) Administering medication;
- (8) Confidentiality of records;
- (9) Release of medical information;
- (10) Participation of residents in activities related to fundraising and publicity;
- (11) Participation of residents in research projects;
- (12) The photographing and audio or audio-visual recording of residents and clarification of the facility’s prohibited use of social media to ensure that all staff, either contracted or directly employed, receive training relative to the restrictive use of social media;
- (13) Hazards risk assessment and emergency/disaster procedures, pursuant to 42 C.F.R. § 441.184 (2019), including the provision that when the psychiatric residential treatment facility has an interruption in services or a change in the licensed location due to an emergency situation, the psychiatric residential treatment facility shall notify the Office of Long-Term Care no later than the next stated business day;
- (14) Reportable incidents, sentinel events, and critical incidents; and
- (15) Factors that determine room assignments, including, but not limited to, age and diagnoses.
(d)
- (1) Pursuant to Arkansas Code § 5-13-202(a)(4)(E), the administration of a facility shall post a notice that attacking a healthcare professional, including a nurse, is a felony.
(2)
- (A) Said notice shall be posted:
(i) At entrances to a healthcare facility, emergency department, clinic, or long-term care facility that are used by patients, residents, and visitors; and
(ii) In patient or resident waiting areas of a healthcare facility, emergency department, clinic, or long-term care facility.
- (B) The text of the notice shall read: "We respect you. Please respect our staff. Attacking a healthcare worker is a FELONY*. *Arkansas Code § 5-13-202."
