20 CAR § 414-1003 – Incidents or occurrences that require internal reporting only — Facsimile report on Form DMS-762 not required

(a) The following incidents or occurrences shall require the facility to prepare an internal report only and does not require a facsimile report, Form DMS-7734, or Form DMS-762 to be made to the Office of Long-Term Care.
(b) The internal report shall include all content specified in 20 CAR § 414-1004, as applicable.
(c)
1. (1) Nursing facilities must maintain these incident record files in a manner that allows verification of compliance with this provision.
2. (2)
  1. (A) Incidents where a resident attempts to cause physical injury to another resident without resultant injury.
  2. (B) The facility shall maintain written reports on these types of incidents to document patterns of behavior for subsequent actions.
3. (3) All cases of reportable disease, as required by the Department of Health.
4. (4) Loss of heating, air conditioning, or fire alarm system of greater than two (2) hours duration.
