(b) There must be responsible direct care staff on duty and awake on a twenty-four-hour basis, when clients are present, to take prompt, appropriate action in case of injury, illness, fire, or other emergency, in each defined residential living unit housing:

1. (1) Clients for whom a physician has ordered a medical care plan;

2. (2) Clients who are:

   1. (A) Aggressive;
   2. (B) Assaultive; or
   3. (C) Security risks; and
3. (3) Fewer than fifteen (15) clients in a multi-unit building.

(c) There must be a responsible direct care staff person on duty on a twenty-four-hour basis when clients are present to respond to injuries and symptoms of illness, and to handle emergencies, in each defined residential living unit housing:

1. (1) Clients for whom a physician has not ordered a medical care plan;

2. (2) Clients who are not:

   1. (A) Aggressive;
   2. (B) Assaultive; or
   3. (C) Security risks; and
3. (3) Fifteen (15) or fewer clients.
