1. (a)

   1. (1) Each assisted living facility must have written policies and procedures to ensure that residents receive medications as ordered.
   2. (2) In-service training on facility medication policies and procedures (see 20 CAR § 411-407(a)(2)(A) and (b)) shall be provided at least annually for all facility personnel supervising or administering medications.

2. (b)

   1. (1) Facilities must comply with applicable state laws and rules governing the administration of medications and restrictions applicable to nonlicensed personnel/staff/employees.

   2. (2)

      1. (A) However, licensed nursing personnel (RNs, LPNs) may administer medication in accordance with 20 CAR §§ 411-402 and 411-403 in cases in which the resident is assessed as being unable to self-administer his or her medication.
      2. (B) In such cases, the facility shall document, and shall be responsible to ensure, that medications are administered by licensed nursing personnel/staff/employees, and are administered without an error rate greater than five percent 5% (see 20 CAR § 411-1104(a) and (b)).
