(a)
- (1) Each assisted living facility must have written policies and procedures to ensure that residents receive medications as ordered.
- (2) In-service training on facility medication policies and procedures (see 20 CAR § 411-407(a)(2)(A) and (b)) shall be provided at least annually for all facility personnel supervising or administering medications.
(b)
- (1) Facilities must comply with applicable state laws and rules governing the administration of medications and restrictions applicable to nonlicensed personnel/staff/employees.
(2)
- (A) However, licensed nursing personnel (RNs, LPNs) may administer medication in accordance with 20 CAR §§ 411-402 and 411-403 in cases in which the resident is assessed as being unable to self-administer his or her medication.
- (B) In such cases, the facility shall document, and shall be responsible to ensure, that medications are administered by licensed nursing personnel/staff/employees, and are administered without an error rate greater than five percent 5% (see 20 CAR § 411-1104(a) and (b)).
