(a) Admission criteria.
- (1) The Level I assisted living facility shall not admit any resident whose needs are greater than the facility is licensed to provide.
(2) The Level I assisted living facility shall not provide services to residents who:
- (A)
(i) Need twenty-four-hour nursing services except as certified by a licensed home health agency for a period of sixty (60) days with one (1) thirty-day extension.
(ii) A copy of the licensed home health agency’s plan shall be filed in the resident’s record;
- (B) Are bedridden;
- (C) Have transfer assistance needs, including but not limited to assistance to evacuate the facility in case of emergency that the facility cannot meet with current staffing; or
- (D) Present a danger to self or others or engage in criminal activities.
- (b) Preadmission evaluation. Each applicant shall receive an initial evaluation completed by the facility prior to admission to determine whether the resident’s needs can be met by the assisted living facility and the resident’s needs are not greater than the facility is licensed to provide.
