(b) If transportation services are offered, whether provided directly or under contract, the facility shall ensure that:

1. (1) The driver has a valid Arkansas driver’s license;
2. (2) Liability insurance is in force;
3. (3) All vehicles have seat belts;
4. (4) All clients wear seat belts while being transported;
5. (5) Any charge for transportation shall be described in advance to the client or responsible party;
6. (6) All applicable federal, state, and local laws and ordinances are followed concerning the condition of the vehicle used for transportation and the manner in which it is operated; and
7. (7) Add locking mechanisms for vans with wheelchairs.
