(a) Each person or legal entity issued a license to operate an adult day health care facility shall, through their employees and agents, provide an organized program of supervision, care, and services that:
- (1) Conform to Office of Long-Term Care rules;
- (2) Meet the needs of the clients of the facility;
- (3) Provide for the full protection of clients’ rights; and
- (4) Promote the social, physical, and mental wellbeing of clients.
(b) The facility shall provide any authorized agents of the Department of Human Services or their designee full access at any time during business hours to:
- (1) Clients;
- (2) Grounds;
- (3) Buildings; and
- (4) Books, files, and/or papers relating to clients or operation of the facility.
- (c) The facility shall provide for maintenance and submission of such statistical, financial, or other information, records, or reports in such form, at such time, and in such a manner as the department may require.
- (d) The facility shall provide for notification to the department when incidents/accidents occur involving the facility or its clients as specified in 20 CAR § 409-305.
