The facility shall:
(1)
- (A) Permit unrestricted visiting hours.
- (B) However, facilities may deny visitation when visitation results or a substantial probability exists that visitation will result in disruption of service to other clients or threatens the health, safety, or welfare of the client or clients;
(2)
(A) With the exception of fish in aquariums and service animals (e.g. guide dogs), live animals shall not be permitted in:
- (i) Common dining areas;
- (ii) Storage areas;
- (iii) Food preparation areas; or
- (iv) Common serving areas.
- (B) Pets may be permitted in adult day care facilities if sanitary conditions and appropriate behavior are maintained.
(C) If the facility permits pets, the facility shall ensure that:
- (i) The facility is free of pet odors; and
- (ii) Pets’ waste is disposed of regularly and properly.
- (D) Pets must not present a danger to clients or guests.
- (E) Current records of inoculations and license, as required by state law or local ordinance, shall be maintained on file in the facility.
- (F) For purposes of this part, “pets” mean domesticated mammals (such as dogs and cats), birds or fish, but not wild animals, reptiles, or livestock.
- (G) Parameters for pets, including behavior and health, must be set and be included in the admission agreement;
- (3) Require that conduct in the common areas is appropriate to the community standards as defined by the clients and staff;
- (4) Ensure that clients not perform duties in lieu of direct care staff, but may be employed by the facility in other capacities;
- (5) Ensure that clients are not left in charge of the facility; and
(6) In the event of a client’s acute change of condition or accident:
(A)
- (i) Notify the client’s responsible party or next of kin.
- (ii) A competent client may decline to have someone contacted, if such a request is in writing and filed in the client’s file;
- (B) Take immediate steps to see that the client receives necessary medical attention including transfer to an appropriate medical facility; and
- (C) Make a notation of the illness or accident in the client’s records.
