(a)

1. (1) Any person who submits evidence of having maintained employment in the State of Arkansas for the past twelve (12) months and of successfully completing a criminal record check within the last twelve (12) months or in accordance with that person's professional license shall not be required to apply for a new criminal record check.
2. (2) Copies of the previous criminal record check and determination letter issued by the Office of Long-Term Care must be maintained by the facility for verification of this provision.
3. (3) These persons shall be subject to the same periodic checks as other employees as described in 20 CAR § 404-202.

(b)

1. (1) Note. The acceptance of a previously conducted criminal record check is contingent upon compliance with provisions set forth in this part.
2. (2) All provisions, such as the requirement for a national record check, must have been completed, if applicable.
3. (3) The criminal record check must have been processed and a determination of employment status made by the office.
