20 CAR § 400-2403

Matters which may be heard at IDR

Arkansas Code § 20-10-203; Arkansas Code § 20-10-216; Arkansas Code § 20-10-224

(a) The IDR is limited to deficiencies cited on a statements of deficiencies.
(b) Issues that may not be heard at an IDR include, but are not limited to:
1. (1) The scope and severity assigned the deficiency by the Office of Long-Term Care, unless the scope and severity allege substandard quality of care or immediate jeopardy;
2. (2) Any remedies imposed;
3. (3) Any alleged failure of the survey team to comply with a requirement of the survey process;
4. (4) Any alleged inconsistency of the survey team in citing deficiencies among facilities; and
5. (5) Any alleged inadequacy or inaccuracy of the IDR process.

Codification Notes: “IDR” means informal dispute resolution.
