(a)

1. (1) Every firm, person, or corporation violating any of the provisions of this part shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not less than one hundred dollars ($100) nor more than five hundred dollars ($500) or by imprisonment not exceeding one (1) month, or both.
2. (2) Each day of violation shall constitute a separate offense.

(b)

1. (1) Every firm, person, or corporation who violates this part may be assessed a civil penalty by the State Board of Health.
2. (2) The penalty shall not exceed one thousand dollars ($1,000) for each violation.
3. (3) Each day of a continuing violation may be deemed a separate violation for purposes of penalty assessments.
