(a)

1. (1) Each practitioner who discovers any suspected loss, theft, or other diversion, or any combination thereof, of any controlled substance shall immediately notify by phone or fax the:

   1. (A) Pharmacy Services and Drug Control Section of the Department of Health; and
   2. (B) Arkansas State Board of Pharmacy.
2. (2) The nearest Drug Enforcement Administration Diversion Field Office must be notified in writing within one (1) business day of the discovery of any suspected loss, theft, or diversion.
3. (3) In addition, practitioners shall file theft and loss reports, Drug Enforcement Administration Form 106, with Pharmacy Services and Drug Control Section, the Drug Enforcement Administration, and the board within seven (7) days of the occurrence of said loss or the discovery of said loss.

(b)

1. (1) Long-term care facilities (LTCFs) that discover any suspected loss, theft, or other diversion, or any combination thereof, of any controlled substance shall immediately notify Pharmacy Services and Drug Control Section by phone or fax.
2. (2) In addition, LTCFs shall file Department of Health theft and loss report form PHA-21 with Pharmacy Services and Drug Control Section.
