20 CAR § 140-107
(a) Location.
(1) Surface drainage. Every well must be located:
(i) Either underground seepage or channels;
(ii) Lakes;
(iii) Ponds; and
(2) Proximity to sources of contamination.

(B) Deviation from ownership of the restricted buffer (wellhead protection) zone may be approved by the department for a portion of the restricted buffer (wellhead protection) zone when:
