- (a) All existing pools/spas which are not in compliance with this part at the effective date shall be exempt from compliance with those construction provisions which do not pertain directly to health and safety of the patrons.
- (b) All pools/spas, when remodeled, shall comply with all applicable provisions of this part pertinent to the renovation, unless a variance is granted by the Department of Health.
- (c) Any variance shall be granted in writing for a specific time period.
