The following operations are not subject to this part:
- (1) Establishments engaged solely in the harvesting, storage, or distribution of one (1) or more "raw agricultural commodities," as defined in § 201(r) of the Federal Food, Drug, and Cosmetic Act of 1938, which are ordinarily cleaned, prepared, treated, or otherwise processed before being marketed to the consuming public.
