Before a permit or permit application for a nonincinerator commercial medical waste treatment, storage, and/or disposal (TSD) facility is granted, the following conditions will be met by the Department of Health:
- (1) Notice by certified mail to the mayor of the city and the county judge of the county or counties where the property is the subject matter of the permit application is located; and
- (2) A public hearing shall be held in the county or counties in which the facility is to be located.
