- (a) No person may operate a commercial medical waste incineration or nonincineration treatment, storage, and/or disposal facility or a mobile system, not to include a POTW, without first obtaining an operating license from the Department of Health.
- (b) The operating license will be issued for a period of one (1) year.
- (c) Storage capacity, efficacy testing, and operating rates will be outlined in the operating license.
- (d) The Division of Environmental Quality may set the operating rates for incineration technologies.
- (e) Procedures for obtaining an operating license are outlined in 20 CAR § 53-520.
