(b) This part does not apply to medical waste generated by the operation of:

1. (1) Hotels;
2. (2) Motels; or
3. (3) Other accommodations providing lodging for the public and not serving as a commercial or professional office where individuals, who are not family members, are receiving medical care by a healthcare professional.
