- (a) Operating room facilities shall be provided for laparoscopic retrieval and ultrasound-guided retrieval.
- (b) The operating room availability must be rigidly controlled so patients can be moved in and out seven (7) days a week with a maximum of twenty-four (24) hours’ notice.
- (c) Anesthesia must be available seven (7) days a week.
- (d) A facility of oocyte and sperm culturing shall be close to the operating room with two-way communication.
(e)
- (1) Any in vitro fertilization facility offering services on an outpatient basis that requires the use of general or intravenous anesthetics that render the patient unable to be responsible for his or her actions, and where, in the opinion of the attending physician, hospitalization is not necessary, shall comply with all applicable Sections 0100 through 1800 (excluding 0900 and 1200 through 1600) of the Rules for Hospitals and Related Institutions in Arkansas of the Department of Health, 20 CAR pt. 41.
- (2) The most current rules shall apply.
- (f) An in vitro fertilization procedure is so complex and highly technical that a large back-up system of laboratory support and specialized personnel should be available seven (7) days a week.
(g)
- (1) Other assisted reproductive technology (ART) that can include, but not be limited to, in vitro fertilization (IVF), gamete intra-fallopian transfer (GIFT), tubal embryo transfer (TET), zygote intra-fallopian transfer (ZIFT), and others should be considered to be governed by this part.
(2) All facilities licensed or certified by the Department of Health offering these services shall:
- (A) Conform to the current guidelines of the American College of Obstetricians and Gynecologists; and
- (B) Also meet the minimal standards of the American Society for Reproductive Medicine.
