Inpatient care shall be:

1. (1) Available for:

   1. (A) Pain control;
   2. (B) Symptom management; and
   3. (C) Respite purposes; and

2. (2) Provided in licensed facilities, as stated below:

   1. (A) Inpatient care for symptom control.

      1. (i) Inpatient care for pain control and symptom management shall be provided in one (1) of the following:

         1. (a) (a) A hospice that meets the requirements for providing inpatient care directly as specified in 20 CAR § 47-121, inpatient direct care.; or
         2. (b) (b) A hospital or a skilled nursing facility (SNF);
      2. (ii) Each shift shall include a registered nurse onsite to supervise and provide direct patient care; and

   2. (B) Inpatient care for respite purposes. Inpatient care for respite purposes shall be provided by one (1) of the following:

      1. (i) A hospice that meets the requirements for providing inpatient care directly as specified in 20 CAR § 47-121, inpatient direct care; or
      2. (ii) A hospital, skilled nursing facility (SNF), or nursing facility.
