1. (a) It shall be the duty of the administrator or his or her designee to report all infectious or communicable diseases in the facility to the Department of Health as required by:

   1. (1) The Rules Pertaining to Reportable Diseases, 20 CAR pt. 102, Arkansas Code §§ 20-7-109 and 20-7-110; and

   2. (2)

      1. (A) CMS mandatory reporting requirements for Medicare-certified facilities.
      2. (B) See 20 CAR § 41-117(a)(3).

2. (b)

   1. (1) Occurrences that threaten the welfare, safety, or health of the public such as epidemic outbreaks, poisoning, etc., shall be reported either by phone or facsimile to the local or State Health Officer.
   2. (2) The institution shall furnish other pertinent required information related to the occurrence to the department.
3. (c) Immediate capacity for disaster admissions shall be reported daily to the Disaster Preparedness Program of the Department of Health.

4. (d)

   1. (1) The facility shall submit to the Division of Vital Records of the Department of Health a report on each abortion complication, including live birth, diagnosed or treated by the facility not later than the thirtieth day after the date on which the abortion complication was diagnosed or treated.

   2. (2) The report must:

      1. (A) Include the name of the physician submitting the report and type of healthcare facility submitting the report;
      2. (B) Not identify by any means the:

5. (i) Physician performing the abortion; or

   1. (ii) Patient on whom the abortion was performed; and

      1. (C) Include:

         1. (i) The most specific, accurate, and complete reporting for the highest level of specificity; and
         2. (ii) The following:
6. (a) (a) The date of the abortion that caused or may have caused the abortion complication;

7. (b) (b) The type of abortion that caused or may have caused the abortion complication;

   1. (c) (c) The gestational age of the fetus at the time the abortion was performed;

      1. (d) (d) The name and type of healthcare facility in which the abortion was performed;
8. (e) (e) The date the abortion complication was diagnosed or treated;
9. (f) (f) The name and type of any healthcare facility other than the reporting healthcare facility in which the abortion complication was diagnosed or treated;
10. (g) (g) A description of the abortion complication;

11. (h) (h) The patient’s:

    1. (1) (1) Year of birth;
    2. (2) (2) Race;
    3. (3) (3) Marital status;
    4. (4) (4) State of residence; and

    5. (5) (5) County of residence;

       1. (i) (i) The date of the first day of the patient’s last menstrual period that occurred before the date of the abortion that caused or may have caused the abortion complication, if known;
12. (j) (j) The number of previous live births of the patient; and
13. (k) (k) The number of previous induced abortions of the patient.
14. (e) The facility shall report to the division when a known transfer occurs of a patient from the care of a lay midwife during the labor and delivery process.
15. (f) A hospital shall submit reports to the Department of Health as defined in the Rules Pertaining to Hospital Discharge Data System, 20 CAR pt. 52.
