20 CAR § 1-404 – Who may request the registration of and sign a delayed certificate of birth

(a) Any person born in this state whose birth is not recorded in this state, or his or her parent, guardian, next of kin, or older person age twenty-eight (28) years or over acting for the registrant and having personal knowledge of the facts of the birth may request the registration of a delayed certificate of birth, subject to this part and instructions issued by the State Registrar of Vital Records.
(b)
1. (1) Each delayed certificate of birth shall be signed and sworn to before an official authorized to administer oaths by the person whose birth is to be registered if such person is:
  1. (A) Age eighteen (18) years or over; and
  2. (B) Competent to sign and swear to the accuracy of the facts stated therein;
2. (2) Otherwise, the certificate shall be signed and sworn to by one (1) of the following in the indicated order of priority:
  1. (A) One (1) of the parents of the registrant;
  2. (B) The guardian of the registrant;
  3. (C) The next of kin of the registrant; or
  4. (D) Any person eighteen (18) years or over having knowledge of the facts of birth.
