(a) Until the registrant's first birthday, given names may be amended upon written request of:

1. (1) Both parents;
2. (2) The mother in the case of a child born out of wedlock;
3. (3) The father in the case of the death or incapacity of the mother;
4. (4) The mother in the case of the death or incapacity of the father; or
5. (5) The guardian or agency having legal custody of the registrant.

(b)

1. (1) After one (1) year from the date of birth, the provisions of 20 CAR § 1-1404 must be followed to amend a given name if the name was entered incorrectly on the birth certificate.
2. (2) A legal change of name order must be submitted from a court of competent jurisdiction to change a given name after one (1) year.
