(a) All commercial or transitional production swine transported into Arkansas shall have an official premise identification, be individually identified, and be accompanied by a certificate of veterinary inspection and permit number unless:

1. (1) Moved directly to slaughter and individually identified with an official ear tag; or
2. (2) Under a commercial commuter agreement approved by the Arkansas Board of Animal Health.

(b) Breeding swine.

1. (1) All breeding swine imported into Arkansas not under the authority of a commuter swine agreement must:

   1. (A) Have an official premise identification;
   2. (B) Be individually identified; and
   3. (C) Be accompanied by a certificate of veterinary inspection and permit number.
2. (2) Pseudorabies vaccinates may not enter.

3. (3) Testing requirements of all breeding swine not under the authority of a commuter swine agreement are as follows:

   1. (A) Brucellosis. All animals over six (6) months of age must:

(i) Be tested negative within thirty (30) days prior to shipment; or

1. (ii) Originate directly from the farm of origin of a validated free herd;

   1. (B) Pseudorabies. All ages must:

      1. (i) Be tested negative within thirty (30) days prior to shipment; or
      2. (ii) Originate directly from the farm of origin of a pseudorabies qualified herd; and

   2. (C) Retest. Retesting shall be performed as required under United States Department of Agriculture laws and regulations.

      1. (c) Feeder pigs.

2. (1) All feeder pigs not under the authority of a commuter swine agreement being imported into the state must:

   1. (A) Have an official premise identification;
   2. (B) Be individually identified;
   3. (C) Be accompanied by a certificate of veterinary inspection; and
   4. (D) Have a permit number.
3. (2) Pseudorabies vaccinates may not enter.

4. (3) Testing requirements and allowable movements of all feeder pigs not under the authority of a commuter swine agreement are as follows:

   1. (A) All animals over six (6) months of age must be tested negative for brucellosis within thirty (30) days prior to shipment;
   2. (B) All ages must be tested negative for pseudorabies within thirty (30) days prior to shipment;
   3. (C) That the swine enter on permit directly to a designated feedlot and not through an all-class market;
   4. (D) That the swine originate from an approved feeder-pig market or direct from a qualified-negative herd or feeder-pig monitored herd;
   5. (E) That the swine be quarantined to slaughter only; and

   6. (F) That the designated feedlot has no breeding swine on the premises and no breeding herds within two (2) miles.

      1. (d) Entry for sale in Arkansas:

5. (1) All swine entering Arkansas for sale shall be identified by an official premise identification and either:

   1. (A) Be tested negative for pseudorabies and brucellosis within thirty (30) days prior to sale;
   2. (B) Originate directly from a qualified-validated commercial production swine herd;
   3. (C) Originate directly from a feeder-pig-monitored commercial production swine herd; or
   4. (D) Meet the requirements for an Arkansas surveyed herd; and

6. (2) Any swine entering Arkansas for sale that do not meet these requirements shall be:

   1. (A) Individually identified;
   2. (B) Isolated from all tested swine;
   3. (C) Tested at the market at the owner’s (seller’s) expense; and
   4. (D) Sold for slaughter only.
