(a) Pursuant to Arkansas Code §§ 2-16-610(e) and 2-16-617(a), any cotton grower who fails to pay all assessments and/or penalties within thirty (30) days after notice from the State Plant Board shall, upon direction of the board, destroy all cotton plants:
- (1) In which the cotton grower has an interest; and
- (2) Which are subject to assessments.
(b)
- (1) Any such cotton plant not destroyed shall be deemed a public nuisance.
- (2) The board may apply to any court of competent jurisdiction for the issuance of a judgment and order for condemnation and destruction of the nuisance.
- (3) The cotton grower shall be liable for all court costs, fees, and other expenses incurred in any action taken under this section.
