(a) Pursuant to Arkansas Code §§ 2-16-610(e) and 2-16-617(a), any cotton grower who fails to pay all assessments and/or penalties within thirty (30) days after notice from the State Plant Board shall, upon direction of the board, destroy all cotton plants:

1. (1) In which the cotton grower has an interest; and
2. (2) Which are subject to assessments.

(b)

1. (1) Any such cotton plant not destroyed shall be deemed a public nuisance.
2. (2) The board may apply to any court of competent jurisdiction for the issuance of a judgment and order for condemnation and destruction of the nuisance.
3. (3) The cotton grower shall be liable for all court costs, fees, and other expenses incurred in any action taken under this section.
