2 CAR § 51-107 – Entry of authorized personnel upon properties

(a) Pursuant to Arkansas Code § 2-16-607(b), State Plant Board personnel are authorized to inspect any fields or premises and any property located therein or thereon for the purpose of determining whether such property is infested with the boll weevil.
(b)
1. (1) Such inspections must be conducted between sunrise and sunset.
2. (2)
  1. (A) Such inspections include, but are not limited to:
(i) Taking of specimens;
1. (ii) Examining and obtaining records; and
  1. (iii) Applying or supervising treatments to the:
(a) (a) Soil;
(b) (b) Plants; or
1. (c) (c) Any regulated articles.
  1. (B) This may include removal and destruction of:
    1. (i) Plants;
    2. (ii) Plant parts; or
    3. (iii) Other regulated articles.
