(a)

1. (1) Thousand cankers disease is a disease complex involving the walnut twig beetle (Pityophthorus juglandis) and a Geosmithia fungus.
2. (2) These organisms attack and eventually kill walnut trees.

3. (3)

   1. (A) The disease has spread across the western United States and poses a serious threat to the native black walnut trees of Arkansas.
   2. (B) Black walnut trees are prized:

(c) (c) Ornamental shade qualities; and

1. (ii) As a vital component in the forest ecosystem.

2. (4)

   1. (A) This quarantine is in place to keep the disease from spreading into Arkansas from infested areas.
   2. (B) The thousand cankers disease quarantine shall be effective on filing of rule.
   3. (C) The specific requirements of the quarantine are as follows.

(b) Quarantine areas. Entire states of:

1. (1) Arizona;
2. (2) California;
3. (3) Colorado;
4. (4) Idaho;
5. (5) Nevada;
6. (6) New Mexico;
7. (7) Oregon;
8. (8) Tennessee;
9. (9) Utah;
10. (10) Washington; and

11. (11) Any other state or foreign country known to be infested.

    1. (c) Regulated articles.

12. (1) All plants and plant parts of the genera Juglans including but not limited to nursery stock, budwood, scionwood, green lumber, and other material living, dead, cut, or fallen, including:

    1. (A) Logs;
    2. (B) Stumps;
    3. (C) Roots;
    4. (D) Branches; and
    5. (E) Composted and uncomposted chips.
13. (2) All life stages of the walnut twig beetle (Pityophthorus juglandis) and all life stages of the Geosmithia fungus (Geosmithia morbida).

14. (3) Firewood of any nonconiferous (hardwood) species.

    1. (d) Restrictions.

15. (1)

    1. (A) Except as otherwise provided herein, all commodities and articles covered are prohibited entry into or through Arkansas from areas under quarantine unless specifically listed as exempt (see subdivision (d)(2) of this section).
    2. (B) No person, firm, corporation, or other entity shall import, plant, receive for delivery, or otherwise accept or bring into Arkansas any regulated articles from any thousand cankers disease of black walnut infested area designated by the State Plant Board.

16. (2) Commodities exempt from quarantine requirements:

    1. (A) All nuts, nut meat, and hulls of the genera Juglans;
    2. (B) Milled lumber one hundred percent (100%) bark-free, kiln-dried with squared edges;

    3. (C) Finished walnut wood products without bark, including walnut:

       1. (i) Furniture;
       2. (ii) Instruments; and
       3. (iii) Gun stocks; and
    4. (D) Nonviable, preserved specimens of the walnut twig beetle (Pityophthorus juglandis).

(e) Penalties.

1. (1) As per the existing penalty matrix in this part, see Addendum A.
2. (2) The quarantine is effective until the board amends the quarantine or determines that the quarantine is no longer necessary.
