(a) The following requirements must be met by processors of all classes of certified seed:
- (1) Facilities shall be available to perform processing without introducing admixtures;
- (2) Identity of the seed must be maintained at all times;
- (3) Records of all operations relating to certification shall be complete and adequate to account for all incoming seed and final disposition of seed;
- (4) Processors shall permit inspection by the certifying agency of all records pertaining to all classes of certified seed;
- (5) Processors shall designate an individual who shall be responsible to the certifying agency for performing such duties as may be required by the certifying agency;
(6)
- (A) Seed lots of the same variety and class may be blended and the class retained.
- (B) If lots of different classes are blended, the lowest class shall be app lied to the resultant blend.
- (C) Such blending can only be done when authorized by the State Plant Board;
(7)
- (A) All seed approved for certification must be packed in new containers or approved reusable containers as indicated below:
- (i)
- (a) (a) Foundation class.
- (b) (b) New flexible minibulk (superbag) containers.
(c) (c) Note. Lot size for foundation class crops packed in these containers is limited to one thousand five hundred (1,500) bushels per lot;
- (ii)
- (a) (a) Registered class.
(b) (b) New flexible minibulk (superbags) or rigid minibulk containers (as approved by the State Plant Board Seed Division) for all crops.
(c) (c) Note. Lot size for registered class crops packed in these containers is limited to three thousands (3,000) bushels per lot; and
- (iii)
- (a) (a) Blue tag class approved reusable containers are the following:
(b) (b) Rigid minibulk containers (as approved by the State Plant Board Seed Division), for:
- (1) (1) Soybeans;
- (2) (2) Rice; or
(3) (3) Wheat; and
- (c) (c) Flexible minibulk containers (superbugs, new or cleaned) for:
- (1) (1) Soybeans;
- (2) (2) Rice; or
(3) (3) Wheat.
- (B) Blue tag class wheat may be sold in bulk, (see 2 CAR § 34-217); and
- (8) New moisture tests are not required on lots after treatment (with fungicides, etc.) if the lot met the standards for moisture when sampled for complete analysis before treatment.
(b) Bulk transfers.
(1)
- (A) Seed eligible for certification may be sold from one (1) seedsman to another while in bulk, provided that the identity of the seed has been maintained at all times and that the appropriate documents have accompanied the shipment.
- (B) Contact the board for specific instructions.
- (C) Inspectors shall make random checks to see that the seed is being properly handled.
