1. (a) Each application shall be accompanied by a nonrefundable fee of fifty dollars ($50.00).
2. (b) A license is issued for one (1) year for an annual fee of two hundred dollars ($200.00).
3. (c) For a renewal license, the same fee schedule will apply as in this subsection.

4. (d) Fees paid for a license are not refundable:

   1. (1) Once the licensee takes possession of seed or transplants; or
   2. (2) If the license is revoked for any cause over the duration of the license.
5. (e) The initial and renewal license fees are due annually when the license applicant is notified of the acceptance of a license application and before the licensee takes possession of the seed or transplants, whichever is earlier.
6. (f) The license holder shall be responsible for the cost of all inspection and sampling services.
7. (g) The license holder shall be responsible for the cost of all laboratory analytical services.
8. (h) Any applicant or licensee participating in the Arkansas Seed Certification Program is responsible for all fees and rules associated with the Industrial Hemp Research Program.

9. (i)

   1. (1) The license holder shall be responsible for the cost of any other oversight required by the State Plant Board.

   2. (2) This may include:

      1. (A) Site verification visits;
      2. (B) Seed/propagule verification visits;
      3. (C) Pesticide residue testing;
      4. (D) Staff time; and
      5. (E) Program administration.
   3. (3) A fee schedule will be established on an annual basis and published on the Department of Agriculture's website or be available on request.

10. (j) Established fees.

    1. (1) Grower applications:

       1. (A) Fifty-dollar application fee (nonrefundable);
       2. (B) Two-hundred-dollar license fee;
       3. (C) Two-hundred-dollar modification fee (per modification, maximum of three (3) allowed per license year);
       4. (D) Applied acreage fee:

11. (i) Fifty dollars ($50) for less than five (5) acres;

    1. (ii) One hundred dollars ($100) for five (5) to less than fifty (50) acres;

       1. (iii) Two hundred fifty dollars ($250) for fifty (50) to less than one hundred (100) acres;

          1. (iv) Five hundred dollars ($500) for one hundred (100) to less than two hundred (200) acres; and
          2. (v) One thousand dollars ($1000) for greater than two hundred (200) acres;
       2. (E) One-hundred-dollar applied greenhouse fee (each greenhouse);
       3. (F) One-hundred-dollar lab sample fee (per lab compliance sample);
       4. (G) One-hundred-dollar GPS verification fee for each location ID; and
       5. (H) Twenty-five-dollar hemp transfer fee (each transfer).

    2. (2) Processor/handler license:

       1. (A) Fifty-dollar application fee (nonrefundable);
       2. (B) Two-hundred-dollar license fee;
       3. (C) Two-hundred-dollar modification fee (per modification, maximum of three (3) allowed per license year);
       4. (D) One-hundred-dollar lab sample fee (per lab compliance sample);
       5. (E) One-hundred-dollar GPS verification fee, each location ID;
       6. (F) Twenty-five-dollar hemp material transfer fee (each transfer); and

       7. (G) Applied producer fee:

          1. (i) One thousand five hundred dollars ($1,500) for flower/bud material;
          2. (ii) Five hundred dollars ($500) for fiber, seed, and grain; and
          3. (iii) Five hundred dollars ($500) handler fee.
