- (a) Prior to any suspension, the contractor will be afforded an opportunity to discuss with the State Procurement Director or head of a procurement agency the circumstances which led to the possible suspension and to potentially reach a settlement.
(b) In the event a bidder is suspended, a written determination shall be:
- (1) Made by the director or head of a procurement agency concerning the facts of any allegation or claim that a bidder has done any action in 19 CAR § 1-709(b); and
- (2) Sent to the bidder at the address shown in the procurement agency’s records.
