1. (a) A party submitting a protest has the burden of stating facts showing that the protestor has grounds in connection with a solicitation or in connection with the award of a contract.
2. (b) The State Procurement Director or the head of a procurement agency determining a protest may, but has no duty to, request a protestor or other interested party to submit documentation or information relevant to the protest.
3. (c) Failure of any person to comply expeditiously with a request for documents or information by the director or the head of a procurement agency determining a protest may result in the protest being determined without consideration of the requested information.
4. (d) Delivery of requested documents or information after three (3) business days from the request is generally not considered expeditious, but the director or the head of a procurement agency may allow additional time for good cause.
