17 CAR § 210-901 – Civil penalties, generally

(a) Any person, firm, or corporation that violates provisions of Arkansas Code §§ 17-28-101 – 17-28-310 or Arkansas Code §§ 20-31-101 – 20-31-105, or any rule, regulation, or order promulgated by the Board of Electrical Examiners of the State of Arkansas, or any condition of a license, certificate, or registration issued by the board shall be subject to a civil penalty that shall not exceed the following:
1. (1) Two hundred fifty dollars ($250) for a first offense;
2. (2) Seven hundred fifty dollars ($750) for a second offense; and
3. (3) One thousand dollars ($1000) for a third offense.
(b) Each day of a continuing violation shall constitute a separate offense.
(c) Assessment of a civil penalty shall be made no later than two (2) years from the date of the occurrence of the violation.
(d) The amount of civil penalties will be determined in accordance with 17 CAR § 210-903 and 17 CAR § 210-904.
(e)
1. (1) Nothing in this part shall abridge the authority of the board to revoke or suspend any license for cause.
2. (2) A licensee may be assessed a civil money penalty and have his or her license suspended or revoked for the same offense.
