(a)
- (1) If the Executive Director of the Arkansas Real Estate Commission determines that a complaint establishes a prima facie case of a violation of the Real Estate License Law, Arkansas Code § 17-42-101 et seq., or this part, the executive director shall send a copy of such complaint to the licensee or person allegedly engaged in unlicensed real estate activity complained against along with instructions concerning the filing of an answer.
- (2) The executive director may also send a copy of the complaint to the principal broker of the licensee complained against.
(b)
- (1) Within twenty (20) days after service of the complaint on the licensee or person allegedly engaged in unlicensed real estate activity, such licensee or person allegedly engaged in unlicensed real estate activity shall file a written answer with the executive director.
(2) The answer shall be:
- (A) Dated; and
- (B) Signed by the licensee or person allegedly engaged in unlicensed real estate activity under oath.
- (3) The time for answering may be extended at the discretion of the executive director or the executive director's designee.
