As used in this part unless the context otherwise requires:

1. (1) “Board” means the Arkansas State Board of Pharmacy;

2. (2) “Person” includes:

   1. (A) An individual;
   2. (B) A general or limited partnership;
   3. (C) A corporation;
   4. (D) A business firm;
   5. (E) A limited liability company; and
   6. (F) An association;
3. (3) “List I chemical” means ephedrine, pseudoephedrine, or phenylpropanolamine or their salts, optical isomers, and salts of optical isomers, alone or in a mixture;
4. (4) “Manufacturer” means anyone who is engaged in manufacturing, preparing, propagating, compounding, processing, packaging, repackaging, or labeling of a List I chemical;
5. (5) “Wholesale distribution” means the distribution of List I chemicals to persons other than consumers or patients, but does not include entities exempt by Arkansas Code § 5-64-1006 as amended by Acts 2001, No. 1209; and

   1. (A) “Wholesale distributor” means any person engaged in wholesale distribution of List I chemicals, including but not limited to:

      1. (i) Manufacturers;
      2. (ii) Repackers;
      3. (iii) Own-label distributors;
      4. (iv) Private label distributors;
      5. (v) Jobbers;
      6. (vi) Brokers;

      7. (vii) Warehouses, including:

         1. (a) (a) Manufacturers’ and distributors’ warehouses;
         2. (b) (b) Chain drug warehouses; and
      8. (c) (c) Wholesale drug warehouses;
      9. (viii) Independent wholesale drug traders;
      10. (ix) List I chemical repackagers;
      11. (x) Physicians;
      12. (xi) Dentists;
      13. (xii) Veterinarians;
      14. (xiii) Clinics;
      15. (xiv) Individuals;
      16. (xv) Hospitals;
      17. (xvi) Nursing homes and their providers; and
      18. (xvii) Retail and hospital pharmacies that conduct wholesale distributions.
   2. (B) A wholesale distributor shall not include any for-hire carrier or person or entity hired solely to transport List I chemicals.
