1. (a)

   1. (1) The transfer of original prescription information for a legend drug or a controlled substance for the purpose of dispensing is permissible between pharmacies on a one-time basis only.
   2. (2) However, pharmacies electronically sharing a real-time online database may transfer up to the maximum refills permitted by law and the prescriber’s authorization.

2. (b) Transfers are subject to the following requirements:

   1. (1) The transfer is communicated directly between two (2) licensed or registered individuals where one (1) of the two (2) must be a pharmacist, and the transferring individual records the following information:

      1. (A) Void the transferred prescription;
      2. (B) Record the:

3. (i) Name, address, and Drug Enforcement Administration registration number of the pharmacy to which it was transferred; and

   1. (ii) Name of the individual receiving the prescription information; and

      1. (C) Record the:

         1. (i) Date of the transfer; and
         2. (ii) Name of the individual transferring the information;

   2. (2) The individual receiving the transferred prescription information shall electronically record or reduce to writing the following:

      1. (A) Record that the prescription is a transferred prescription; and

      2. (B) Provide all information required to be on a prescription pursuant to 21 C.F.R. § 1306.05 and include:

         1. (i) Date of issuance of original prescription;
         2. (ii) Original number of refills authorized on original prescription;
         3. (iii) Date of original dispensing;
         4. (iv) Number of valid refills remaining and date or dates and locations of previous refill or refills;
         5. (v) Pharmacy's name, address, Drug Enforcement Administration registration number, and prescription number from which the prescription information was transferred; and
         6. (vi) Name of individual who transferred the prescription;
   3. (3) The original and transferred prescription or prescriptions must be maintained for a period of two (2) years from the date of last refill;
   4. (4) Pharmacies electronically accessing the same prescription record must satisfy all information requirements of a manual mode for prescription transfer;
   5. (5) Pharmacies transferring prescriptions may utilize facsimile or other electronic means to communicate information for transfers; and
   6. (6) Transfers of controlled substances must follow federal laws and regulations.
