1. (a)

   1. (1) The permit licenses the pharmacy to which it is issued and is not transferable.
   2. (2) It is issued on the application of the owner and the licensed pharmacist-in-charge, on the sworn statement that it will be conducted in accordance with the provisions of law.

2. (b)

   1. (1) Pharmacies opening for business must first secure a permit and be licensed with the Arkansas State Board of Pharmacy before they may lawfully conduct or operate a pharmacy.
   2. (2) A fee defined in 17 CAR § 160-107 is charged for issuing such original permit.
   3. (3) All pharmacies must register with the board and secure a biennial permit and pay a renewal fee as defined in 17 CAR § 160-107.

3. (c)

   1. (1) Permits must be posted in a conspicuous place.

   2. (2) This requirement is not met when a permit is:

      1. (A) Locked in a safe;
      2. (B) Placed in a desk drawer; or
      3. (C) Otherwise hidden away.
4. (d) No pharmacy may open for business, nor may it be inspected for the purpose of obtaining a permit, prior to the approval by the board.
