- (a) Arkansas Code § 17-95-409(a)(2)(G) and (J) provides that the Arkansas State Medical Board may revoke or suspend a license if the practitioner is grossly negligent and becomes physically incompetent to practice medicine to such an extent as to endanger the public.
- (b) Pub. L. No. 102-141, passed in the First Session of the 102nd Congress of the United States of America and approved on October 28, 1991, provides that the states will establish guidelines to apply to health professionals and will determine appropriate disciplinary and other actions to ensure compliance with those guidelines in order to prevent the transmission of human immunodeficiency syndrome and hepatitis B virus during exposure-prone invasive procedures except for an emergency situation where the patient’s life or limb is in danger.
